General Provisions
These terms govern the use of photography services provided by Karol Smoliński, operating as FotoSmolik, based in Poznań, Poland.
Scope of Services
FotoSmolik provides photography services including: • Wedding and couples photography • Portrait and personal branding photography • Event and corporate photography • Baptism, communion, and birthday photography • Maternity, newborn, and family sessions • Product photography • Video production (reels, social media content)
Booking
Booking is done through the form on fotosmolik.pl or through direct contact. A booking is confirmed after: 1. Agreeing on session details 2. Paying the deposit 3. Signing the contract (if applicable)
Payment
The deposit amount is specified in the contract (typically 500–600 PLN) and is non-refundable. The remaining amount is due on the day of the session or as specified in the contract. Payments are made via bank transfer to the account provided in the booking confirmation.
Cancellation and Rescheduling
The client may cancel a booking at any time. The deposit is non-refundable. Rescheduling is possible free of charge if requested at least 14 days before the planned session. If the photographer cancels due to unforeseen circumstances, the client receives a full deposit refund or an alternative date.
Delivery
Photo delivery takes 2 to 6 weeks from the session date, depending on the scope of service. Photos are delivered digitally through the Client Portal. The client may select photos for editing (if the service includes this option).
Copyright
The photographer retains full copyright to all photographs. The client receives a license for personal use, including publication on social media with credit to @foto_smolik_. Commercial use (advertising, marketing materials) requires separate written consent and an additional fee. The photographer reserves the right to use selected photos in their portfolio and promotional materials.
Liability
FotoSmolik will make every effort to deliver the highest quality service. The photographer's liability is limited to the value of the contract. The photographer is not liable for circumstances beyond their control (weather, equipment failure, force majeure).
Data Protection
Personal data processing is governed by the Privacy Policy available at fotosmolik.pl/en/privacy-policy.
Final Provisions
Matters not covered by these terms are governed by Polish civil law. FotoSmolik reserves the right to amend these terms. Changes take effect upon publication on the website. Complaints should be submitted by email to kontakt@fotosmolik.pl.
